    at least this state figured it out. it does not matter if light nor not. you were warned and she died from the passion of smoking til her lungs went black! finally someone understands, that person has to be held liable for their own actions.

    wudchuck – you aren’t from around Addison are you?

    Anyway – you got it right! I am a smoker – and by choice. I have the willpower to quit if I wish – but chose to smoke. For these folks to claim that the product is so addictive that they can’t quit is just a smoke screen (cute play on words there) for they don’t want to quit but feel that blaming their desire for a “bad” habit on other factors is a cop-out.

    not fm addison…it’s just getting old and everyone knows that it’s bad for your health. it does not matter if light or not. so long as you smoke it, it can possibly cause cancer. if we were to look at the cases bogged in court and those in backlog, how many can we clear for frivilous? many i would think. how many of these have been sitting for court and decided to see JUDGE Judy or others? the TV network will pay them some money to come on the air to air that laundry. it’s a shame that we can’t take our own responsiblity for our own actions. we have to decide by the court who is actually at fault when it’s fairly clear. too many folks just want the big man’s money because they have a lot. now w/the economy the way it is, more will probably sue thinking there will be less money available. the lawyers need to stop and check the pulse — most of it is on their shoulders. they want the money because they will see it first and probably most of it after they claim fees! especially if the suit was a class-action.

    Is it not the company’s fault? Shut the manufactures down. Make them quit selling cigarettes and give ’em 30 days to get their product out of the market. Pretty simple, it kills. Our people are being killed by a harmful product and yet the FDA will not remove it from the market. It is simply a “cash cow” for States and they ain’t letting go! Collateral damage. This is a travesty on the people of the USA and the World. Our courts will not look at it for what it is which is a bad product designed to kill. Wow. I wish I could make a product and not have the same guidelines as the rest of the population.

    So if that’s the case then why don’t we remove alcohol, fast food, cell phones, etc. How about taking a little responsibility for ones actions for a change. She was warned, she died, end of story.

    simply put, this product has been on the market for more years than almost any other product. can’t we say the same thing about alcohol? it kills and kills not just the person but others as well, if you don’t have sense together while driving other objects or having objects in your possession. where do you simply start saying – you are responsible for your choice? think about this, who picked up that first cigarette or cigar? did you read the label before you did? probably not! so why are we so fundamentally stupid to think labels are being read, when we all know they are not. how many times have kids and adults been told, it’s bad for your health? if i were a manufacturer of cigarettes, this is my business. if folks know the risks, then proceed! how many other drugs say they cause this and this and this, yet we take it because the doctor prescribes it to make you supposedly better. there are natural remedies available, but today’s society likes the idea of the pill. many pill making companies formulate pills just to get you to use them when they don’t really help. like a.d.d., they claimed my son had it, yet we fooled them w/the flinstone vitamin pill. people just don’t want to take the time to pay attention or give it for that matter. yet, these companies are making money — FDA approves the drugs and then something goes wrong — that company is sued. well, why not sue the FDA, afterall they approved the drug. why not sue FDA for cigarettes for that matter? you will probably not see that happen. so, it’s back to the matter of choice. you picked it up and decided to light the object and puff. oops, one was not enough, so a second, then another. but it was you that placed that item into your hand and bring it to your lips for lung pressuration. it’s like saying, i became a race driver, knowing that speed can cause a violent collision and i could lose my life. do i sue who? i knew the risks involved. everyone around me knows the risks involved. i choose to race. i could choose to smoke. key: accept responsiblity of your actions.

    It’s not just a cash cow for the states, some fairly large political families have their fortunes founded on tobacco money.

    I couldn’t agree with you more but you can bet that plaintiff’s attorney is not done yet and will find a way to get this before a court, somewhere; as they say, “justice” denied, ain’t necessarily so. the only thing to stop further litigation is for the courts to rule for defendants and against plaintiff, with prejudice.

    Take it off the market in 30 days, huh? Nothing organized crime would like better; the black market will thrive, and you know why? Because people enjoy killing themselves! I quit in 1992 and have not looked back; it never occurred to me to quit before because I loved to smoke! I don’t smoke anymore but don’t think it is my place to tell others what to do. But as for filing suit for product liability, GMAB! These people want it both ways; its not like they couldn’t guess, even before the surgeon general’s report, that smoking sure wasn’t healthy! I would rather see it as a controlled substance, like methadone, where addicts at least are monitored and can’t complain about being hooked. Cold turkey ain’t easy but it can be done; you just have to want it bad enough.
