83 yr old lady probably does not have 10 million dollars of assets… did the lawyer understand how much value this lady does have? yes, she will be responsible for the accident and the medical costs. more reason that we need to have good licensing test for vision peripheral and driving at the older age. they will probably win, but won’t get much in return.
I feel badly for the driver. Was the cyclist paying attention to his surroundings, or was he racing along with his iPod headphones on, like so many of them do? If the driver turned in front of his path, and he was to her right and in her blind spot, how fast could she have possibly been going, and if he was fully aware of his surroundings, could the cyclist have thus avoided the collision? The cyclist is 20 years old, and presumably has a driver’s license, so should have been aware of the perils an automobile driver contends with, and should have exercised due care to avoid a collision. As cyclists get more lanes for their use, they also need to share the responsibility of safe road usage.
Time to promote those Personal Umbrella policies. $10,000,000 does not sound so high these days. What is a Fair amount for an “accident”?
