The city posted signs warning about swimming, but should have also posted warnings about unsafe sand conditions and advised the public to avoid walking in the area since there were prior deaths from similar situations. The city also assumed liability because the lifeguards took vehicles or personal watercraft to the area to warn people about the dangerous conditions. I think Mrs. Smith’s attorney has a good case for negligence (but what do I know!)

Based upon your logic then the city is responsible for anything that could happen on public land. Say if someone stood at the edge of a cliff and it gave way below them, the community knew or should have known that there was the possibility of said cliff giving way as other cliffs have done the same in similar situations.
I do feel sorry for the family but just because something bad happens to someone does not always indicate someone else has to pay. When will the insanity of our out of control tort system end?
What ever happened to people knowing how to swim ? And since when is the city or state or anyone else responsible for what mother nature does ? Never, at least in a sane world.
