Senate Bill 1, Missouri’s new workers’ comp reform law, contains a drafting error the legislature intends to address during a special session set to take place in mid September. However, since the law goes into effect on Aug. 28, there will be a period of time where the drafting error will stand.
According to the Missouri Insurance Coalition (MIC), the drafting error, if read literally, eradicates the exclusive remedy of the workers’ compensation system with respect to handling employee injuries. Again, the legislature intends to expedite a resolution during the special session. In the meantime, MIC has been in contact with key officials within Gov. Blunt’s administration and reports that the administration is committed to addressing the drafting error.
The administration also expects the workers’ compensation system to continue operating until the legislature addresses the problem.
