Parents of Iowa Teen Killed in Crash Sue Insurer for Underinsured Benefits

The parents of an Iowa teenager killed 10 years ago in a van crash in southern Wisconsin have filed a lawsuit seeking damages for their son’s death.

Albert and Deanna Roberts of DeWitt, Iowa, filed the lawsuit against Iowa Mutual Insurance Co. last week in Clinton County District Court.

The Roberts were insured by Iowa Mutual on March 25, 1999, when their son, Marshall, was killed in an accident near Janesville, Wis.

He was a passenger in a van that rolled several times after the driver, Jeremy Holmes, tried to switch places with another passenger. Seven people were killed.

The van’s occupants were selling magazine subscriptions.

The Roberts claim Iowa Mutual insured them against underinsured drivers, and that their damaged exceeded what they recovered from Holmes.
