Wal-Mart to Pay $11.7 Million to Settle U.S. Gender Bias Lawsuit

    The decree makes Walmart’s hiring practices more fair by making them more unfair. The qualified men who are denied jobs due to this decree should sue Walmart for gender bias.

    next thing you will see is someone that is other than white suing and getting even more money… but here’s my problem, how can we validate these numbers today, tommorrow and even tommorrow’s tommorrow? i can see that we have to treat each other the same, but to mandate numbers, is like mandating the nfl to where they have to interview 1 black person for a head coaching job. (funny, that no female, has been hired for this job yet!) this lawsuit is going to blow open a door for more! it’s going to be rolling stone that will keep on rolling for a long time.

    These were jobs that required “filling orders”, not “giving orders”. I believe that gender matters in determining suitability for these two distinct activities. Just ask my wife.

    Articles like this just twist my panties into a knot. Why is it so hard to treat women fairly? If I was hungry, and Wal-Mart was the only place to buy some food in my town, I would eat dirt first. Phoey on Sam Walton

    If WalMart had not been so blatantly and illegally discriminatory for all these years, there would be no need to sign the consent decree. You make it sound like we should just forget that white men have been favored in hiring for years. What, we should just forget about all the women who have been discriminated against by the evil empire WalMart? What’s fair about that?

    Funny thing is, from the warehouses I’ve been in, women often do a better job selecting than men, especially when picking from the smaller slots and in items that ship less than a case. The only advantage the men have is when picking heavy items. However, a 40 lb sack of produce doesn’t care which gender is moving it as long as it moves.

    Maybe not forget about it but don’t dwell on it. What’s done is done. Move forward. Learn from the past but you won’t get anywhere if you are stuck in the past. To move forward you have to work for the better future. This lawsuit isn’t changing anything except what sex Walmart hires to fill vacant warehouse spots. It won’t change their practices they will just learn to hide it better. I agree about shopping at Walmart, no way.

    So it’s payback time, huh? All you white men who have had it so good for all these years (who also by the way have nothing to do with the past treatment of anyone) are going to suffer. So if a company receives 100 applications from white men for a job but only 10 from women or some minority, who has the better odds of getting hired? Not the white guys. Diversity is only a euphemism for “less white men.” I am the mother of two future white men and I worry for them since their “ethnic group” is so often portrayed as the villains of society.

    Go check out what scholarships are available at colleges…oops- you’re a white male, nothing for you.

    Start a business… oops- you’re a white male, no special status like “woman-owned” or “minority-owned” for you.

    Actually do well at something, congratulations… oops- we all know that since you’re a white male, you harassed some women and discriminated against minorities along the way.

    Disagree with someone who isn’t a white male- oops, there’s your white male neanderthal bigotry showing.

    Yes…now you have an idea of what is was like for women and people of color/diverse ethnic background for the 200 years before affirmative action, and programs that corrected centuries of discrimination.

    I’m so sick of everything having to be FAIR. Life isn’t fair. Accept it and move on. Let businesses hire who they want. If they think hiring old gay mormon black women is best for the company, that’s cool. It’s their decision. If a company’s hiring practices upset people, they’ll show their displeasure with their wallets and the company will be forced to re-think things. Until then, leave companies alone. Consumers and the free market will handle things much better than a poorly run government agency.

    Getting back to the article. Unfortunately Walmart is not an isolated case. The law that was applied to Walmart was Title VII of the Civil Rights Act that is applied on a federal level to companies with 15 or more employees.Some individual statews may have stricter laws than the Federal Law, buat all states as a minimum are subject to Title VII. This law does not allow discrimination of employees based on their race, color, religion, sex, or national origin. The Equal Pay Act of 1964 may have also been applied. The only exception of discrimination in the workplace would be if there was a Bona Fide Occupational Qualification (BFOQ). Race is never a BFOQ. An example of a BFOQ is an advertiser could advertise for only teenage girls if the ad dealt with teen swim wear. Obviously the warehouse would not qualify as women are just as qualified as men as long as they can meet the reasonable qualifications of the job. Before this ever reached the lawsuit stage Walmart had an opportunity to settle this situation with the Equal Employment Opportunity Commission (EEOC). Walmart chose not to settle until after a lawsuit was filed. It looks like Walmart was caught and hopefully they will do a better job in the future to prevent discrimination. Several other companies have settled similar lawsuits, and without a doubt there will be more settlements in the future.

    Good post. I’ve said that in the past too. Why doesn’t the government use affirmative action hiring practices for the senate and the house? Oh because we let the people decide. Good, then let the people decide where they’ll shop.

    And in all fairness, if I’m trapped in a fire, would I want a woman coming into save me or a man from the Fire department? I’d say a man 9 times out of 10. Unless it’s Napalatano coming to save me. I’d hit her over the head and run out and tell Obama to go save her. LOL Bad joke. sorry.

    When I was growing up in Saudi Arabia, women had no chance at a career with Wal Mart, or companies like that. I am so happy to live in a country where women not only have rights, but those rights are recognized and protected by the legal system. Praise Allah!
