Sexual Assault Charges Dropped Against Former AIG Exec McElroy

Authorities in Vermont have dropped sexual assault charges against David McElroy, a former executive at American International Group (AIG).

According to a document filed in Vermont Superior Court in Lamoille County, the state’s attorney for Lamoille County on Dec. 31, 2025 dismissed the charges without prejudice “due to the complaining witness’s ongoing trauma which prevents her from fully participating in the criminal case at the present time.”

Dismissal without prejudice means the case can be brought up again.

Other than confirming the dismissal, McElroy’s attorney David. V. Kirby said there was no additional comment. He previously said his client categorically denied the charges.

David McElroy, most recently chairman of AIG’s General Insurance unit, was charged late in 2024 with three counts of sexual assault and one count of lewd and lascivious conduct. The allegations stemmed from a night McElroy spent with a woman who attended a client conference and fundraiser at the Lodge at Spruce Peak resort in Stowe, Vermont in early March 2024.

McElroy told police he believed the encounter to be consensual. Soon after speaking to police, AIG announced McElroy was retiring on May 1, 2024. The 66-year-old executive, AIG said, agreed to “accelerate his retirement date for personal reasons.”
