The Texas Department of Insurance, Division of Workers’ Compensation (DWC) has revised forms DWC Form-042, Claim for Workers’ Compensation Death Benefits, and PLN-12, Notice of Potential Entitlement to Workers’ Compensation Death Benefits to help eligible beneficiaries file claims for death benefits with DWC or an insurance carrier.
The form revisions are necessary to implement Texas Labor Code Sections 408.182 and 409.007, which were amended by House Bill 2314, 88th Legislature, Regular Session.
The rule was effective December 11, 2023, and beneficiaries and insurance carriers can use the revised forms immediately.
