The West Virginia Supreme Court has refused to reconsider its decision involving DuPont and punitive damages arising out of a pollution case.
Wilmington, Del.-based DuPont asked the court to reconsider a ruling it issued in March involving pollution at a longtime zinc-smelting plant in Spelter.
In seeking the rehearing, DuPont said the court gave too much weight to the medical monitoring issue.
The company said the damages intended to punish DuPont for its behavior should be about $39 million, not the nearly $100 million DuPont is currently ordered to pay.
In a 12-page decision issued, the court said it rejected DuPont’s latest arguments that punitive damages should be modified.
