Tennessee Aims to Change How Workers’ Compensation Disputes Are Settled

    Not all judges favor the injured worker. My husband died 10 years ago with asbestosis. His judge slept through most of the trial. First case he had ever heard for workers comp. Our attorney sent it to the supreme court and they denied it. My husband had total proof he breathed asbestos while working, and witnesses who still worked there testifying for him. If he had won the case he could have had the lung transplant he deserved. May have been able to watch his grandchildren grow. Workers compensation is responsible for workers who are injured on their jobs, but they dont pay because of crooked judges and attorneys who are paid to lie.

    The entire Tenn Workers Comp system is FLAWED in so many ways.From the application questions that only address accidents and or on the job injuries, completely ignoring worker with occupational diseases and or illnesses. Allowing the employers to pick the doctors the injured worker has to see ( we know what the doctors will say) Most PCP are not trained to connect the dots from an occupational disease/illness to a place of employment so therefore it it is next to impossible to “SHOW CAUSE” the very thing the legal system is concerned about and building it case on.The court lawyers, insurers and judges are not familiar with the occupational disease/illness part of the workers comp law and because the lawyers and the courts are handling occupational diseases and or illnesses as accidents and or on the job injuries, many legitimate occupational diseases/illnesses are wrongly denied. The system is GROSSLY FAILING many injured workers. The Workers Comp system is allowing many employers to pass the buck on to the government , SOCIAL Security Disability when the employers should be held accountable for all on the job accidents/injuries or occupational disease/illness . The newly created OMBUDSMAN program is just another program with a lot of “FLUFF” and NO substance. SOUNDS good but DELIVERS very little. The info they pass on we can find it ourselves on the internet. The system SUCKS.
