Mississippi Enacts First Statewide Building Code Law

    The attached article is misleading. Building code adoption and enforcement is primarily the responsibility of local jurisdictions. The bill has “no teeth” since a county or municipality may opt out.

    Building Codes Law
    Mississippi Senate Bill 2378 was approved by the governor on March 17, 2014 and becomes effective on August 1, 2014. At that time, a local government, unless exempted, is required to adopt one of the nationally recognized codes and standards as the State Uniform Construction Code. Within 120 days of August 1, 2014, the board of supervisors of a county and/or the governing authorities of any municipality within a county may choose not to be subject to the code requirements under Section 1 of S-2378.

    Totally agrees with Tom in Iowa: As a code inspector, FHA Compliance inspector and Licensed Home Inspector – this bill is weak, has an attention getting headline and has no teeth (enforcement). Local jurisdictions are able to simply say “no thanks” to this bill and the state (and the insurance companies) can do NOTHING about that vote.

    The article “slightly” mentions the Home Building Industry; builders are 100% in support of a statewide building code.

    Good ole boy politics is still ALIVE AND WELL in the deep south!

    HOLY FREAKING COW!!!!

    I thought every state in the union had industry/residential building standards that were mandated by law. I’m just now learning about this as my husband and I are buying a home in MS. We had a home inspection and discovered the roof requires replacement. HA HA..the sellers insurance agent says they’ll replace it, but just leaves the homeowner to their own devices on who they choose. The guy that they’re hiring doesn’t have a license nor is he bonded, and the county in question isn’t under any obligation to follow “building codes” standards.

    Sounds like a third world story. Course Mississippi isn’t the only state in the U.S. that is slacking.

    On a recent MPB broadcast it was said that there are currently 13 counties in Mississippi that don’t adhere to a building code.Does anyone know which counties those are? I’d like to investigate into building an off grid home there.Thanks.

      Two of them are Lauderdale and Kemper counties outside Meridian. They also have no Comprehensive Plans or zoning (outside the NAS Meridian Airport Environs Zones). You are pretty much left to your own devices there.

    FYI, the state of TN is going in the opposite direction. In 2009 they passed legislation to allow counties to opt out of codes and more than 1 in 3 have done so.
