Someone please find out the background to this story. Every article I read just says her daughter picked it up in the parking lot and she swatted it out of her daughter’s hand and got stuck. How on earth is Target liable? I know medical professionals on HIV preventative cocktails after needle sticks. They all continue to work. I lose a little more trust in our legal system every time I read stuff like this.
Me too! I don’t understand how Target can be responsible for trash left in their parking lot. If that’s the case, stores would be responsible for drug deals that happen in their parking lots too.

Centuries you say ? How many centuries ? It was exclusively inhabited by Native Americans until around 1670. It wasn’t even ‘South Carolina’ until 1729. Have you ever been there? Please don’t go……..you’d hate it, but you’ve already made that clear.
Somehow I was under the impression that a failed legal system was to blame for this miscarriage of …..justice ?

I agree w/ the comments that our legal system has gone over the edge. In cases like this a lawyer and an “injured” person get a big payday, and everyone else gets to pay for it thru higher costs at the register, higher insurance prices, etc. I’d like to know what each of our political candidates will do about meaningful tort reform if elected. We need it in the worst way.
In addition, medical professionals also know that the pathogens in any blood that might have been on the needle only live a few minutes after exposure to air so the risk for contracting any HIV condition are low to none.
Target is responsible for maintaining their premises. Perhaps they should have accepted the settlement offered by the plaintiff attorney, which seems more than reasonable. If they didn’t think they were responsible, they wouldn’t have offered any money at all. $750 seems unreasonable. I’d definitely expect more than that if this were to happen to me. Target goes out and rounds up their carts several times an hour, I don’t think it’s too much to ask that they make sure their premises is free of trash that could cause injury.
Jeeez, people like you are why our legal system is completely broken……no personal responsibility. If any retail establishment tried to adhere to your preposterous standard, you wouldn’t be able to afford to shop there.

I worked at a grocery store in high school. It was fully expected we pick up any trash both inside the store and in the parking lot. If a manager saw an employee walk past trash without picking it up, he or she was reprimanded. I think our management team understood premises liability and the fallouts of not maintaining good housekeeping practices.
Unless Target owns the parking lot they are not responsible for the lot and anything on it. Police won’t write accident reports for auto accidents on the lots, and the only reason Target cleans up the carts from the lot is because they own them, and they want to help people fill them back up again.
The majority of the buildings and the lots are leased.
The “dimwit” who knocked a hypodermic needle out of her daughter’s hand was a normal human being with a maternal instinct for protection of her vulnerable and naive child.
It was entirely predictable behavior to those of us who understand the species.
And I am as big a believer in personal responsibility has anyone. But if the daughter had pricked herself with the needle and come down with some dreadful ailment, we all know there are those who would fault the parent for NOT having the “personal responsibility” to knock the needle out of her hand.
Some of them, likely, the same ones commenting on “personal responsibility” here.

Jax, I would go to the Grand Strand at Myrtle Beach in a heart beat since they have over 100 great golf courses to play there.
Which is pretty awesome for a golf lover, but the best part of the State starts in Charleston and goes south to the Savannah River !

Yes, working at a grocery store and keeping the place well-kept is certainly something worth down voting.
