It is so sad that in times of great need and stress that sometimes the worst of humankind comes out. The good news is that sometimes it is in times of great disasters such as Matthew that the best of humankind comes out as well.
For all of the criticisms of Illinois, they seem to have a better system for civil bad faith under code section 155. Fees/sanctions are generally only available if the carrier’s position is vexatious and/or not subject to reasonable debate (e.g. in direct contradiction to established law). The Florida legislature should take a hard look at code section 215 ILCS 5/155 and consider modifying their section (624.155, I believe) to reduce or eliminate the AOB problem while still allowing both insurers and insureds reasonable rights. My opinion at least.
