    Next up will be unmarried couples living together. How can we discrimate against a couple living together if we are forced to accept unmarried gays? Pretty soon, roommates will have the same rights as well.

    This is crap. The country club is a private club and should be able to decide on their own rules. If they only want two-headed left-handed martians, they should be able to set rules to allow that.

    Yet another reason I will be happy when California drops off into the Pacific.

    So, what I’d like to know is, if it is illegal for same sex people to marry, how does this country club determine if you are “same sex partners” or simply two women that share the same house wanting a freebie. This also applies to all businesses that have to offer the same benefits to homosexuals as they do to married people.

    I think the cart is before the horse.

    Gays and lesbians are paying customers who deserve the same rights as their straight counterparts.

    It is not up to people who are self-righteous and “disgusted” because of their own insecurities and homophobia to make policy decisions for all people. Thank goodness justice was served in this case and too bad for all who disagree. A victory for people who seek equality.

    I disagree that I have a “Hate Filled Soul”. I have several family members and friends who are gay.

    I simply feel that private organizations should be able to determine for themselves their rules. I also feel that by requiring non-married couples of any sort to the same benefits as married couples is opening the door to a nearly socialist state. Pretty much what this is saying is that if you feel strongly about the person you are living with, you should get the same benefits that a married couple recieve.

    Sorry, I don’t feel that this is valid.

    The initial, and now some subsequent, posters expose themselves for the hateful and small minded bigots they are. May they receive as they’ve given.

    I remember when the word “gay” was interchangeable with “black”. (Heck, it still is as many bigots still spew vile and invective our, and other peoples way.) Having been the recipient of hateful actions and words I both empathize and sympathize with the women filing this claim. Brava for them.

    Comments such as these reflect poorly upon our profession and country.

    Anyone who cannot see how fast this country is going downhill morally and ethically is blind or simply chooses to look the other way. Unfortunately, that is what we have too much of, me me me and forget anything and everyone else. Thank God we have someone in office that has values, morals, and is not afraid to let people see that. He does not cater just to get votes as Clinton did or to make everyone like him all the way to his bank (I feel your pain, we did not get Osama because of the possible loss of life, etc.-what was 9/11?). He did not want to do anything that would make him look bad to some people or upset them and we need someone in charge that is not afraid to do that. I think the people that take things like this to the extreme need to get a life, maybe go over to Iraq and see if they can talk the terrorists into becoming sissies and back off so we do not all die from their actions down the road. Unless people wake up, that is exactly where all of us are heading because of this very type of situation. Put your energy to constructive use to benefit country as a whole and everyone in it.

    In California, there are laws granting registered domestic partners the same status as legally married couples in a wide range of situations. The couple mentioned in this article were registered, and therefore they must be treated the same as married couples by the club, according to the decision handed down. Those are the facts.

    Individuals’ opinions of morality do not factor into the judicial decision on the application of this law, nor should they. As insurance professionals, we need to be aware of the laws as they now stand, as they are applied, and how to be prepared for future trends. There are appropriate forums to work to change marriage and marriage-related laws, and express opinions on how they now stand.

    1st) It isn’t alleged ‘immorality’ that is causing America to go down the drain, it’s money! THAT is what’s corrupting society (OH, and don’t even get me started on our oil addiction!)

    2nd) I’m all for gay rights. As recent science has shown, for the vast majority of gays it isn’t a choice, they are BORN gay! Hence, their right to marry should not even be an issue! (Those who disagree need to be reminded that tradtional, even dictionary, definitions have NO place in the law – it wasn’t too long ago that most people thought the world was flat & that slavery was a ‘fact’ of life!

    3rd) THAT SAID, in this case I happen to think the court ruled wrong – as a private club, they SHOULD be allowed to determine who they will give discounts to, ANY discounts.
    NOW, if it was a PUBLIC GOLF COURSE, that would be different! No question there – they would HAVE to provide gay couples the same kind of discount.

    The postings on this article from a few individuals are really very sad. I guess we all know what’s in your hearts – alot of hate. I’m certainly glad I’m not a part of any of your families.

    Oh yes, to the guy who is quoting the Webster’s dictionary – take another look. Mine does not contain the words husband & wife – male/female or anything referring to gender. Perhaps yours is the propagandized version.

    yeah the definition of mariage can be many things but whats next? Suppose I want to marry my pet turtle that can be construed as “legal union of 2 invidiuals” but that doesnt mean it should occur. This is getting out of hand if someone wants to be gay thats fine what goes on in someones bedroom is not my business but they should not be able to have the same rights to marriage as a man and woman. PS there is nothing wrong with “homophobia”, homosexuality is not normal, and because I dont approve of it liberal as ususal resort to name calling on account of an inability to argue a logical point, are you also going to call me “necrophobic” because I, along with most people believe it is abnormal to have relations with dead people?

    Finally, a reasoned and intelligent opinion. Whether we approved of the statue is irrelevant to the issue at hand. The court simply determined whether the statute applied in this instance. If the people of California feel the statute is in appropriate they must push for legislature to change it, not a judge.

    Re 2nd: Dictionary definitions do play a role in the law, as a secondary source only and are not considered determinative, in and of themselves. Legal opinions are rife with definitions of terms provided by Webster’s, Blacks legal dictionary, and other secondary sources.

    Re 3rd: States differ as to an association’s ability to discriminate among its members. The US constitution provides a minimum of protection but states can increase the protection they offer to their citizens through the state constitution, legislation, and through the courts. California has, historically, provided for increased protections than other states. I would have been surprised had the decision come down any different, in California.

    Morally and ethically, I am not a proponent of gay marriage. At the same token, in a free and democratic society I do not believe we can discriminate against people who are “different” than us, be it, national origin, gender, or sexual preference.

    This decision has the potential to have a dramatic effect on businesses in California. If a private club can not discriminate amongst its members, how then can an insurance company offering services to the public hope to distinguish between a married couple and a registered domestic partners? Not being personally familiar with insurance practices in CA, perhaps such changes have already been effectuated?

    1) Ok. This case is all about applying the state of CA’s Domestic Partner Law.
    So, the question naturally arises: can it be appealed to the US Supreme Ct?

    2) If it does go to the US Supreme Ct, I can’t help but be reminded of the old Boy Scouts case (i.e. keeping homosexuals out of the Scouts), which the Scouts won, am I right?

    3) THAT said, I repeat: I am all for gay rights! In a way, I happen to think that the CA law (I’m a resident here) doesn’t go far enough!
    a) As per the US Supreme Ct: Seperate but equal is inherently unequal!
    b) ‘Marriage’ & ‘Domestic partners’ looks to me like a form of Jim Crow. Would the current Court reach the same conclusion? I think it’s possible, if this case goes to that level.
    c) Do CA registerd domestic partners get to file joint returns in here? I really don’t know & I’d be interested in finding out!
    d) Re: Taxes – It seems to me gay couples don’t get many of the benefits (taxes & other benes) offered to straight couples, esp. on the federal level.
    It does look discriminatory to me, esp. since science has shown gays are born that way. (OH, & it was years ago that psychiatrists came to that conclusion – just by talking with them they came to realize gays were born that way, i.e they may not be ‘normal’ in the ‘traditional’ sense, but they ain’t ‘abnormal’ either!!)

    4) AND, to those who speak of ‘purpose’: Please bear in mind that the use of that term is a ‘faith’ statement!
    NOONE can say what the ‘purpose’ of life on earth is with ANY certainty, let alone the ‘purpose of our sex organs!
    Besides, since we can ALL agree that the FUNCTION of our sex organs is propagation who’s to say that THAT (reproduction) is the ‘purpose’ of life?

    I think this case has the potential to be HUGE, if not nationally at least in terms of how CA businesses operate. It should be watched closely & discussed openly (& hopefully without too much namecalling!).

    That could be one of your children, or one of your parents, or even your spouse that you are throwing around such hateful words about. We “all” have rights, we “all” feel love, and we should “all” support eachother. What is wrong with you that you feel so compelled to hate? Where did your parents go wrong? Gay,Straight,Bi-Sexual,Black,White,Purple,we should all be equal and stop the B.S. that people in this world like yourselves have created. A “GAY” soldier died in Iraq this week fighting for you and your children to stop terrorism, should he not have been allowed to protect you because of his sexuality? I’m sure he is survived by his partner that cries the same way you do, or feels the pain and mourns the loss the same way you do, I’m sure his Mother is just as proud of him as any Heterosexual soldiers Mother is. So maybe, just maybe you’ll stop and think before you open your mouth and think of how others feel before you spew your hateful thoughts outloud. My Mother taught me to not say anything if you have nothing nice to say.

    Marriage may not be legal in California, but in California Domestic Partner Registration is available for Gay and Lesbian couples who wish to solidify their relationship. Registration grants, I believe (I am not a resident of the state), all the same rights and priveledges on a state level, not federal, to Gays and Lesbians as their heterosexual counterparts receive as married couples.

    The term equal is thrown about a lot today when talking about people. Well equal is not a psychological term it is a mathematical term. But I guess if one looks at individuals as numbers, then the term equal can be used to described them. However how does noe distinguish the term individual from equal. As far a myself, I am not equal to any other person nor is any other person equal to me. I am an individual and resent comparing me to anyone else. If all persons are equal then why are some so wealthy and I am so poor? The only thing in the world that is equal is same number. And no I do not believe fags should have the same rights as us poor ol simple folks. I do have a peace agreement with them though, they leave me alone and I leave them alone.

    The Encarta dictionary reads: equal: with the same rights, having the same privileges,rights,status,and opportunitites as others. With all citizens equal under the law.

    So Tom, the word to, too or two doesn’t have the same meaning either. Try educating yourself.

    Bill Gates recently gave a speech at a High School about 11 things they did not and will not learn in school. He talks about how feel-good, politically correct teachings created a generation of kids with no concept of reality and how this concept set them up for failure in the real world.

    Rule 1:Life is not fair – get used to it!

    I understand and agree with all the Bill Gates items, but what’s that got to do with calling liberals FREAKS? I’m actually more of a conservative (as I age), but the beauty of America is the balance and the polarization between the two, conservatives vs. liberals. That’s what America was founded on. The CHOICE. But from an objective standpoint, a conservative is just as much a freak as a liberal is…it just depends on what side of the fence you’re on. That’s my point.
