Idaho Passes New ATV Liability Coverage Requirements

April 16, 2009

The 2009 Idaho Legislature has passed, and Gov. C.L. Butch Otter has signed into law, two bills affecting the insurance coverage requirements for all-terrain vehicles, specialty off-highway vehicles, utility type vehicles and motorbikes. The bills are Senate Bill 1098 and Senate Bill 1131.

Both bills took effect upon signing by the Governor on April 9, 2009, with the exception of certain fee provisions in Senate Bill 1098. Based on these changes to the law, previous Bulletin 09-01 discussing liability coverage requirements for motorbikes, allterrain and utility type vehicles is rescinded and should no longer be relied upon for
guidance, the Department of Insurance said.

The Department if advising all carriers and insurance producers offering insurance coverage for vehicles to carefully review the bills on-line through the website of the Idaho State Legislature at www.legislature.idaho.gov.

Persons with questions regarding this bulletin should contact the Department of Insurance. Any questions regarding registration requirements for ATVs or other types of vehicles should be directed to the Registrations Section of the Idaho Department of Motor Vehicles or a local DMV office.
