A federal appeals court has ordered Campbell County Memorial Hospital in Wyoming to pay a Nevada woman $2 million for damages she suffered when a doctor there failed to diagnose that her husband had broken his neck in a vehicle accident.
The 10th Circuit Court of Appeals in Denver this week reinstated a jury award of $2 million to Rebecca Prager of Nevada. The appeals court decision overturns an earlier order by a federal judge in Wyoming reducing her award from $2 million to $500,000.
The appeals court also upheld the jury award of $7 million to Prager’s husband, oilfield worker Louis C. Prager. The jury found his left arm was paralyzed after a doctor failed to diagnose that he had broken his neck in the 2008 rollover accident.
