    Below is a copy of an unanswered email directed to consumer help at AZ Insurance.org. It seems unconscionable that condo owners, who sustained water damage as a result of a faulty sprinkler system, should be responsible for payment of a $10,000 bldg deductible. And this, pro-rated according to the extent of their damages! To my mind, the deductible should be apportioned as a special assessment to be divided amongst all owners. Any comments and/or guidance would be appreciated!! Here is the email:

    RE: Faulty sprinkler/water damage on June 13, 2017 at:

    I am writing on behalf of the owners of this unit which sustained heavy water damage. The sprinkler in a small office/bedroom discharged accidentally on the above date. There was nobody home at the time. This sprinkler along with several other sprinkler heads were replaced in March of this year by Element Fire Protection LLC, Fire Protection and Services. 21712 E. Domingo Road Queen Creek, AZ 85142. We are now advised by the HOA through their management company – WeAreVision – that, regardless of whose fault it was, even if it was the building, the affected unit owners will have to pay the $10,000 building deductible in proportion to the extent of damage to each unit. This unit and the owner of the unit immediately below (unit 1109) sustained the most damage with 2 others only minor damage. This does not seem right. Could it possibly be that innocent unit owners are liable for paying the building deductible when it the loss was caused by faulty workmanship by the sprinkler installers? Is there no duty on the part of HOA or their Property Management Co. to attempt recovery from their Sprinkler Co?
    I would appreciate any guidance or advice you may be able to give at this time.
