Decision in Uber Employee vs. Contractor Suit Cuts Driver Bargaining Power

    Courts seem to always have Ubers back. I am still not sure how Uber gets away with not paying work comp. Any contractor or company who hires an independent contractor who is uninsured always gets hit in an audit. I know Uber gets out of it by saying they do not control the work that is done or manner and means which it is performed but I’m not seeing it.

      Mark, I have studied the IRL test for Independent Contractor. This ways heavily not so much for Uber, but more so for Independent Contractor status. They are using their own vehicles and working when they want to work. I know many drivers are just fine with this deal because I use Uber often and they tell me. Maybe 1 in 10 drivers I talk to are disgruntled and this is who is behind this. Uber works because the marketplace wants it, the drivers love making the money and some even like doing it, the riders demand this service and if it’s changed, you will lose drivers and riders. Drivers don’t want to be told when they can work (this will happen if they become employees) and rider are willing to pay only so much (rates will go up with employees) otherwise they will just drive or catch a ride.
