Evelina Ortiz Rosario, 49, of Modesto, Calif., was arrested at her residence and booked into the Stanislaus County Jail on five counts of insurance fraud.
Rosario was working at Big Lots in Santa Clara, Calif., when she injured her left knee while picking up a box on Aug. 7, 2001. She then allegedly filed a workers’ comp claim with Sentry Insurance Company.
After the initial injury, Rosario told doctors her discomfort level, while performing certain activities, was an eight or nine on a scale of one to 10. Sentry believed Rosario was misrepresenting her true capabilities in order to collect workers’ comp benefits.
In Nov. 2001, Sentry videotaped Rosario performing activities that she had previously claimed she was unable to do.
The potential loss on this claim for Sentry was $12,701.
