According to the National Association of Independent Insurers (NAII), the Ohio House Insurance Committee approved legislation that repeals recent state supreme court decisions that have threatened the Ohio insurance marketplace.
The NAII maintains that SB 97 fixes the Linko decision by removing the mandatory offer of uninsured and underinsured motorist (UM/UIM) coverage. It also provides an exclusion from coverage under an employer’s insurance policy when an employee is driving while not working. The proposal would also place a three-year limit on claims that insured drivers can make under their UM/UIM insurance coverage.
Robert Hurns, counsel for the NAII said a critical element of the legislation is the removal of the mandatory offer, a provisions the Supreme Court has repeatedly used to further expand UM/UIM coverage beyond the normal scope of coverage.
