The state’s claim it shouldn’t have to pay what could be record damages for causing an accident that permanently disabled a Schuyler man won’t be heard by the Nebraska Supreme Court.
The court overruled a motion from the state that it get another hearing in the case of Jacob Wagner.
Wagner has brain and vision damage following a 1999 accident at a Schuyler intersection where two traffic signals, one for westbound traffic, the other for southbound, both flashed green.
Both the Colfax County District Court and state high court have ruled the state was at fault because it did not fix the signal even after numerous reports that it wasn’t working.
Wagner’s family could receive more than $8 million in damages.
