The Michigan Department of Insurance and Financial Services (DIFS) has summarily suspended the licenses of insurance agent Daniel Castle and Mears Insurance Agency.
Mears marketed business through the website theatreinsurance.com and the “National Community Theatre Coalition”, a theater insurance program operated by Castle.
Mears Insurance Agency is located at 14061 13 Mile Rd, #2, Warren, Michigan with a branch office located at 4747 1st Street, New Era, Mich.
DIFS reported that after receiving complaints it opened an examination and discovered repeated instances where customers had not received the insurance coverage for which they paid. Other policies were bound and then cancelled by the insurer for non-payment despite customers having paid Castle and the Mears Agency.
It was also found that Castle failed to keep records of insurance transactions as required by state law and insurance payments were combined with money from Castle’s bakery business which was run out of the same location as the insurance agency.
DIFS records also showed that business was placed with surplus lines insurers, although neither Castle nor Mears have a surplus lines license.
A complete copy of the order can be found on the DIFS website.
