It’s a shame that some people have forgotten the #1 rule they learned in 1st grade about keeping their hands to themselves.
However, strictly from an insurance perspective.. Since management knew – maybe not to the extent or severity – about the harassment, but neglected to take the matter seriously, will their EPLI coverage or any other cover this lawsuit?

Would appreciate any response or clarity as I am very new to insurance. Thanks

The answer to your question about EPLI coverage, of course depends on the policy form’s language. Not all are the same. I do know that the form my company sells would cover the employer if they are found guilty of sexual harassment of the employee. In fact, our form also provides coverage for third parties that are harassed (e.g. customers).

No, you don’t have to reach to absurdity to come to a resolution. She asked for a sign, she was given paper. They talk about emergency signals, they aren’t even connected.. How about the multi billion dollar company comes up with some connected devices? There are teams of Risk Management professionals that would be able to find a solutions for this… and it wouldnt be hiring everyone a security guard.

Any action would have been helpful.

Common sense would have you use a male janitor to clean the lobby men’s room and a female housekeeper to clean the women’s.

Mr. King, I don’t know the configuration of the bathroom in question, nor its distance from the front desk, but it’s pretty easy to block a person into a room, and for a cry for help to go unheard. Please, don’t place the responsibility on the housekeeper to look after her own safety when forced into a vulnerable position, that’s just blaming the victim.

I frequently use Marriot and other hotels, the restrooms couldnt be further from the front desk. You’re correct, its victim blaming. I think they should shut the bathrooms down if cleaning. Even though it extremely annoys me.
