The Texas Workers’ Compensation Commission (TWCC) public hearing originally set for August 22 has been rescheduled Thursday, August 29, 2002, at 10:30 a.m. at the Southfield Building, Tippy Foster Room (Room 910), in Austin.
Included in the agenda will be topics related to the new medical fee guidelines that were adopted by TWCC last spring and were scheduled to go into effect Sept. 1. That plan was upset last week when a Travis County judge stayed implementation of the guidelines on grounds that the TWCC did not adequately justify its actions in basing the rates on the federal Medicare schedule. The judge made the ruling in a case brought against the TWCC over the fee schedule by the Texas Medical Association and the Texas AFL-CIO (Texas AFL-CIO and Texas Medical Association vs. Texas Workers’ Compensation Commission, Cause No. GN202.203, District Court, Travis County, Texas).
The hearing agenda includes consideration of amendments or other action regarding Chapter 134, Benefits-Guidelines for Medical Services, Charges, and Payments, including: Rule 134.1, Use of the Fee Guidelines; Rule 134.201, Medical Fee Guideline for Medical Treatments and Services Provided under the Texas Workers’ Compensation Act; and Rule 134.202, Medical Fee Guideline.
