On April 1, 2004, in anticipation of enactment of workers’ compensation reform legislation in the near future, the California insurance commissioner issued a Notice of Proposed Action and Notice of Public Hearing, according to the WCIRB. The public hearing will be held on April 29, 2004, at 9:30AM in the 22nd Floor Hearing Room at 45 Fremont Street, San Francisco, California.
In his notice, the insurance commissioner stated that the pure premium rates to be effective July 1, 2004, would be part of a WCIRB filing letter to be submitted before the date of the hearing if reform legislation is enacted. The proposed pure premium rate change, if any, will be based on (1) reform legislation enacted before the date of the hearing; (2) insurer losses incurred during 2003 and prior accident years valued as of December 31, 2003; and (3) insurer loss adjustment expenses for 2002 and prior years.
On March 25, 2004 the WCIRB Governing Committee voted not to file for changes to the advisory pure premium rate level effective July 1, 2004; however, the Committee recognized that a rate filing might be necessary if workers’ compensation legislation affecting the cost of benefits were enacted.
