The parents of a 10-year-old boy who was shot and killed by another boy in March have filed a lawsuit against the shooter’s father and the apartment complex where the shooting occurred.
The Great Falls Tribune reports Spring Iszler and Michael McCorkle filed the lawsuit on Oct. 31 alleging Gregg Zindell and Aspen Village are liable in the wrongful death of their son, Shelby McCorkle.
The complaint alleges Gregg Zindell knew his 12-year-old son had mental problems and had assaulted and threatened other residents of the apartment complex where he worked as a maintenance man. It also alleges Zindell was negligent in leaving his son alone with access to a rifle and ammunition.
Zindell’s son pleaded “true” to a charge of negligent homicide in juvenile court and was given a suspended sentence.
