Arkansas Measure Would Cap Medical Non-Economic Damages at $250K

Arkansas Attorney General Leslie Rutledge has approved the wording of a measure to limit lawsuit damages awarded against health care providers, clearing the way for supporters to try and put the proposal on the November ballot.

Rutledge certified the proposed constitutional amendment backed by a group of the providers. The measure would allow the Legislature to cap non-economic damages awarded for medical injury against health care providers, with a minimum cap of $250,000. The proposal would also put a limit on the contingency fees attorneys could receive in medical injury cases.

Rutledge’s certification means the group can begin gathering the nearly 85,000 signatures needed from registered voters to put the proposal on the ballot.
