A new appellate court ruling says Arizona cities aren’t legally on the hook for accidents involving street intersections still under state control.
The Court of Appeals ruling came in a lawsuit filed by a woman injured in a collision at a Kingman intersection near Interstate 40.
The woman sued both the city and the state, alleging that they were negligent in the operation and maintenance of the intersection.
The Court of Appeals upheld a trial judge’s ruling that the state still had liability because it controlled the intersection, though the state had consulted the city on changes to the intersection.
