A Canadian trucking company that is suing the state of New Hampshire over winter road conditions that led to the Interstate 93 traffic death of a 6-year-old boy says the state is withholding police accident reports in an attempt to stymie the company’s claim.
The company, Fidele Tremblay of Sainte-Luce, Quebec, alleges the Transportation Department failed to clear ice and snow off the highway in February 2007, leading to the accident.
Brendon Mahoney was killed when his mother’s van was hit by a tractor-trailer that jackknifed on the slippery road. His mother won a $2.5 million settlement from Fidele Tremblay.
The New Hampshire Union Leader reports in a court filing, Assistant Attorney General Lynmarie Cusack wrote the police reports on other accidents aren’t relevant to the case.
