A Delaware couple has been arrested for insurance fraud after filing false medical claims for an automobile accident that never occurred, leading their insurance provider to be billed more than $100,000.
“We take insurance fraud seriously,” said Delaware Insurance Commissioner Trinidad Navarro in a Delaware Department of Insurance (DOI) press release. “Even though this incident allegedly took place in New Jersey, the defendants’ insurance coverage was in Delaware. Our fraud investigators acted on information they received and did a thorough follow-up investigation that ultimately led to these arrests.”
Diliana Legros and her husband, Joseph Aubourg, both of Milford, Del., were indicted by a Delaware Grand Jury on June 4 for insurance fraud and arrested after turning themselves in to Capital Police on June 11. The defendants were processed, arraigned and released on a $1,000 unsecured bond each.
An investigation conducted by the DOI ultimately found the defendants filed insurance claims for injuries from an automobile accident in New Jersey, which never occurred. As a result of these false claims, their insurance provider received more than $100,000 in medical bills and paid out more than $55,000.
This came about after Legros reported an accident claim to her and Aubourg’s auto insurance company on November 16, 2016. The defendants claimed that on November 12, 2016, Legros, Aubourg and two of their children were traveling from New Jersey back to Delaware when a Mini Cooper with New York tags merged into their lane and struck their vehicle. Legros and Aubourg reported that the driver of the Mini Cooper failed to stop. However, they were able to secure the Mini Cooper’s license plate number. Despite securing the tag number, neither defendant notified the police.
Aubourg, Legros and their two children claimed injuries and were treated by a chiropractor located in Milford, Del., as well as other medical professionals. Upon inspection of the reported striking vehicle and interviews of the vehicle owner, however, investigators were able to provide evidence proving the accident never occurred.
